1. Introduction and Acceptance

These Terms of Service (“Terms”) are an agreement between you and RX Sports Massage, LLC (“RX Sports Massage,” “we,” “us,” or “our”), located at 1810 Schneidmiller Ave, Suite 231, Post Falls, ID 83854. They cover your use of our website and the massage therapy, assisted stretching, postural assessment, corrective exercise, compression therapy, and related services we provide.

By visiting the website, booking an appointment, joining a membership, or receiving services from us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website or book with us.

We have written these Terms in plain language. They are still a binding agreement. If you have questions, contact us before you book (see Section 16).

2. Who Can Use Our Website and Services

  • You must be at least 18 years old to book an appointment or create an account on your own.
  • Minors under 18 may receive services only when a parent or legal guardian books the appointment, signs the intake and consent forms, and attends the first session. Clinic policy may require the parent or guardian to remain present during treatment.
  • You must provide true, accurate, and complete information when booking and on all intake forms, and keep it up to date.
  • You may not use the website or services for any unlawful purpose or in a way that harms us, our staff, or other clients.

3. Our Services

RX Sports Massage provides therapeutic and sports massage designed for athletes, fitness enthusiasts, and active people. Services may include sports massage, recovery massage, deep tissue, Swedish, hybrid sessions, pre- and post-competition massage, assisted stretching, compression therapy, postural assessment, corrective exercise guidance, and discovery calls. All massage services are performed by therapists licensed by the State of Idaho.

Your therapist selects techniques based on your presentation and goals. Techniques such as cupping, trigger point work, tissue flossing, or instrument-assisted soft tissue mobilization are included within your session when appropriate. There are no separate add-on or “elevation” fees for these techniques.

We may add, change, or discontinue services, session lengths, or membership plans at any time. Changes will not affect appointments already booked and paid for, unless we cancel them and refund you.

4. Not Medical Advice

Massage therapy is a complementary therapy. It is not a substitute for medical diagnosis, treatment, physical therapy, or emergency care. Our therapists do not diagnose medical conditions, prescribe medication, or provide medical advice. Nothing on our website, in our discovery calls, or during a session should be taken as medical advice.

If you have a medical condition, are pregnant, have had recent surgery, or are under a physician’s care, consult your healthcare provider before booking. Tell your therapist about any condition, injury, medication, or concern before each session. If you feel unwell during a session, tell your therapist immediately.

Results vary from person to person. We do not guarantee any particular outcome, relief, or performance improvement.

5. Booking, Card on File, and Payment

5.1 Booking

Appointments can be booked through the online booking tool on our website (provided by MassageBook), by phone, or in person. Online booking is subject to MassageBook’s own terms and privacy policy. Walk-ins are welcome when the schedule allows but cannot be guaranteed.

5.2 Card on file

A valid credit or debit card must be on file before an appointment can be booked. The card reserves your appointment time and provides a payment method if our cancellation policy applies. Your card will not be charged simply for booking. Card details are stored securely by our payment provider, not by us.

5.3 Prices

Prices are shown on the website and in the booking tool and may change without notice. The price in effect when you book is the price you will be charged for that appointment. Prices do not include gratuity, which is optional and at your discretion.

5.4 Payment

Payment is due at the time of service unless you have prepaid or are covered by a membership plan. We accept major credit and debit cards and HSA/FSA cards for eligible services. We do not bill health insurance directly and cannot guarantee that any insurer will reimburse you.

5.5 HSA and FSA cards

Accepting an HSA or FSA card does not mean your plan will treat the charge as an eligible expense. Eligibility depends on IRS rules and your plan’s requirements. Your plan may require a Letter of Medical Necessity from a physician or other qualified provider. It is your responsibility to check with your plan administrator before your appointment. We will provide itemized receipts on request but cannot guarantee reimbursement.

6. Cancellations, Rescheduling, and No-Shows

When you book, that time is reserved exclusively for you. Late cancellations and missed appointments prevent us from offering the time to someone else who needs care. Our cancellation policy applies to all clients equally.

  • 24-hour notice: please cancel or reschedule at least 24 hours before your appointment. Cancellations and reschedules made outside this window are free, and your card will not be charged.
  • Late cancellation: cancelling or rescheduling with less than 24 hours’ notice may result in a cancellation fee charged to the card on file. The current fee is stated in the booking tool and at the clinic.
  • No-show: missing an appointment without notice may result in a fee up to the full price of the scheduled service.
  • Late arrival: if you arrive late, your session may be shortened so the next client is not delayed, and you will be charged for the full booked session.
  • Exceptions: we understand emergencies happen. Whether a fee is waived is decided case by case, based on the circumstances and your appointment history.
  • Repeat late changes: if you frequently cancel or change appointments at the last minute, we may ask you to prepay, or discuss whether your current schedule is right for your needs.
  • Our cancellations: if we must cancel, for example due to therapist illness or weather, we will contact you as soon as possible and offer to reschedule or refund any prepayment in full.

7. Memberships and Prepaid Plans

  • Membership plans give you a set number of sessions or a discounted rate in exchange for a recurring monthly payment charged to your card on file.
  • The plan terms, including price, number of sessions, rollover rules, and minimum commitment, are shown when you sign up and form part of these Terms.
  • Unless the plan says otherwise, memberships renew automatically each month until you cancel. To cancel, notify us in writing (email or text is fine) at least 7 days before your next billing date. Cancellation takes effect at the end of the current billing period.
  • Unused sessions have no cash value and are not refundable, but may roll over as described in your plan.
  • Memberships are personal to you and cannot be transferred or shared unless your plan specifically allows family sharing.
  • We may change membership prices or terms with at least 30 days’ notice. If you do not agree to the change, you may cancel before it takes effect.

8. Refunds

  • Completed services are not refundable.
  • Prepaid single sessions cancelled with at least 24 hours’ notice will be refunded to the original payment method or held as credit, your choice.
  • Membership payments already charged are not refundable except where required by law or where we cancel the membership ourselves.
  • If you are unhappy with a session, please tell us within 48 hours. We will listen and may offer a credit or other remedy at our discretion.

9. Client Conduct and Professional Boundaries

RX Sports Massage is a professional therapeutic practice. To protect our clients and staff:

  • All services are strictly non-sexual. Any sexual comment, request, or behavior will end the session immediately, the full session fee will be charged, and you will not be permitted to book again. We may report such conduct to law enforcement.
  • Treat our staff and other clients with respect. Abusive, threatening, or discriminatory behavior will not be tolerated.
  • Do not arrive for a session under the influence of alcohol or drugs. Your therapist may refuse or end the session, and the full fee will apply.
  • Do not come in with a contagious illness, fever, open wounds, or a skin infection. Please reschedule; our normal cancellation policy will be applied with flexibility in these cases.
  • Follow your therapist’s draping and positioning instructions. You will always be professionally draped, and only the area being treated will be uncovered.
  • You may stop the session at any time for any reason. Your therapist may also end a session if they believe continuing is unsafe or inappropriate.

10. Assumption of Risk and Release

Massage and manual therapy involve physical contact and pressure on muscles, joints, and soft tissue. While generally safe, they carry some risk, including temporary soreness, bruising, fatigue, lightheadedness, or aggravation of an existing injury or condition. By receiving services you confirm that:

  • You have disclosed all relevant health conditions, injuries, surgeries, medications, and allergies on your intake form and will update your therapist before each session.
  • You understand that your therapist relies on that information to treat you safely, and that withholding information increases your risk.
  • You will speak up during the session if pressure is too intense or anything feels wrong.
  • You accept the ordinary risks of massage therapy and release RX Sports Massage and its therapists from claims for injuries resulting from your failure to disclose a condition or follow instructions.

This release does not apply to injuries caused by our own negligence or misconduct, and nothing in it limits rights you have under Idaho law that cannot be waived.

11. Website Use

11.1 Permitted use

You may use our website to learn about our services, book appointments, and contact us. You may not:

  • Copy, scrape, or republish the website’s content, images, or design without our written permission.
  • Attempt to access areas of the website, booking system, or server you are not authorized to use.
  • Upload malware, submit spam through our forms, or interfere with the website’s operation.
  • Use automated tools (bots, scripts) to book appointments or harvest data.
  • Impersonate another person or book on someone else’s behalf without their permission.

11.2 Availability

We try to keep the website available and accurate, but we do not promise it will be error-free or uninterrupted. We may change, suspend, or remove any part of the website at any time.

11.3 Third-party tools

The website uses tools provided by other companies, including the MassageBook booking widget, Google Analytics and Google Tag Manager, Google reCAPTCHA on our forms, Google Maps, and a review display widget that shows our public Google reviews. Your use of those tools is subject to their own terms and privacy policies. We are not responsible for their content or performance.

12. Intellectual Property

The RX Sports Massage name, logo, website content, photographs, text, graphics, and design are owned by RX Sports Massage, LLC or used with permission, and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

Reviews and testimonials you submit to us or to public platforms may be displayed on our website. By submitting a review or testimonial directly to us, you give us permission to use it, along with your first name and last initial, in our marketing. You can withdraw this permission at any time by contacting us, and we will remove it from materials we control.

13. Disclaimers and Limitation of Liability

To the fullest extent allowed by Idaho law:

  • The website and its content are provided “as is” without warranties of any kind, whether express or implied, including warranties of accuracy, merchantability, or fitness for a particular purpose.
  • We are not liable for indirect, incidental, special, or consequential damages, including lost income, missed competitions, or lost opportunities, arising from your use of the website or our services.
  • Our total liability to you for any claim related to the website or a service will not exceed the amount you paid us for the service that gave rise to the claim in the 12 months before the claim arose.

Some states do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability for death, personal injury caused by our negligence, fraud, or anything else that cannot be limited by law.

14. Indemnification

You agree to cover our reasonable costs, including attorney fees, if we are sued or face a claim because you broke these Terms, gave us false health or identity information, or misused the website. We will notify you promptly of any such claim and let you take part in the defense.

15. Dispute Resolution and Governing Law

  • Talk to us first: if you have a problem, contact us and give us a fair chance to resolve it. Most issues can be sorted out with a conversation.
  • Governing law: these Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules.
  • Where disputes are heard: any lawsuit related to these Terms or our services must be filed in the state or federal courts located in Kootenai County, Idaho, and you agree to the jurisdiction of those courts. Claims that qualify may instead be brought in small claims court.
  • Time limit: any claim must be filed within one year after it arises, unless the law sets a longer period that cannot be shortened.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the new version on the website and update the effective date at the top. For significant changes, such as changes to the cancellation policy or membership terms, we will also notify active clients by email or text before the change takes effect. Continuing to use the website or book services after a change means you accept the updated Terms. If you do not accept them, you may cancel your membership or stop using our services.

18. General Terms

  • Entire agreement: these Terms, our Privacy Policy, your signed intake and consent forms, and any membership agreement make up the complete agreement between you and us. If the documents conflict, the signed forms and membership agreement control for the matters they cover.
  • Severability: if a court finds any part of these Terms unenforceable, the rest still applies.
  • No waiver: if we do not enforce a term right away, we can still enforce it later.
  • Assignment: you cannot transfer your rights under these Terms to anyone else. We may transfer ours if the business is sold or reorganized.
